Nirbhaya Case Update: Vinay Sharma Challenges The Rejection Of His Mercy Petition, Asks For Life Imprisonment. When Is This Going To End?
It has been eight years since Nirbhaya aka Jyoti Singh was brutally gang-raped and murdered. She was gutted, thrown off a moving bus and left to die naked by the side of the road on a cold winter night in December 2012. This incident proved to be a slap in all our faces, it was our wake-up call to face reality. But as it turns out, no amount of protests, candle marches or memorials can get her justice. Her rapists- Vinay Sharma, Pawan Gupta, Mukesh Singh, and Akshay Singh are still breathing after being awarded the capital punishment two times already, dates and everything declared.
They have successfully managed to evade death twice by exploiting every single legal loophole or remedy they could find. They all worked in tandem by filing petitions at the last minute that require the date to be pushed further.
After a whole lot of drama and problems caused by these four, the HC finally said they had only one week to file all their petitions. But clearly that ruling hasn’t fallen into place either since it has been over a week and they are still alive. In fact, there is a stay on their execution with speculation rife about whether they will be hung together as required by law, or separately.

Now, Vinay Sharma whose clemency plea was rejected by the President on 1st February has challenged its rejection in the Supreme Court. His lawyer, AP Singh has sought for life imprisonment instead of execution. I don’t know if you remember but Mukesh too had challenged the rejection of his mercy plea. I don’t know what makes him feel like he is eligible for forgiveness and a life of free air and free food after what he has done. It feels like they are all going in circles following each other and it is really getting on our nerves.
Earlier in the day, the SC also allowed the centre to move the trial court for a fresh death warrant against these four convicts. The date for the hearing has been set on 13th February and a notice has been issued to the convicts.

The only convict who hasn’t made his move yet is Pawan Gupta. Neither has he filed a curative petition in the Apex court, nor has he filed a mercy petition before the President. I can bet good money he and his lawyers are waiting for the new date that is going to be set two days from now.
We can’t even begin to imagine the agony that Nirbhaya’s mother Asha Devi must feel watching her daughter’s rapists’ toy with the law like this. All we can do now is hope that whatever date is set this time, is the date Nirbhaya finally gets justice.
